Constitutional court lifts ban on commercial conversion of residential plots in Karachi

The Federal Constitutional Court (FCC) has overturned an earlier ruling that barred the conversion of residential plots into commercial properties in Karachi, restoring the authority of relevant departments to process land-use changes under existing laws.

As per news report, the case relating to illegal constructions in Karachi was heard by a bench led by Justice Aamir Farooq.

While lifting restrictions on the conversion of private residential plots, the court ruled that the status of public spaces such as parks, hospitals and playgrounds could not be changed under any circumstances.

During the proceedings, the bench observed that the judiciary would no longer interfere in the administrative affairs of institutions including the Sindh Building Control Authority.

Justice Aamir Farooq remarked that, following the removal of suo motu powers, complaints regarding building violations should now be pursued through appropriate legal forums and the High Court.

He stated that the court’s role was to ensure implementation of existing laws rather than legislate, adding that officials violating regulations would face legal action.

The court also expressed the expectation that town planning authorities would perform their responsibilities in good faith and in accordance with the law.

By withdrawing the earlier restrictive ruling, the bench cleared the way for legal commercial activity on private plots while maintaining that public and communal land must remain protected.
